The rightwing will have you believe that things like “social services” and “regulation” are wastes of government time and energy, and a waste of our tax dollars. No my friends, mind-numbingly stupid laws like this are what waste our time and money:
Charles Kay, of Edinburg Township, was pulled over recently by police in Ravenna. His only offense? Hanging a small, leaf-shaped air freshener. Ohio law requires drivers to have an unobstructed view of the road. Kay was let off with a warning. He wasn’t speeding, swerving or running traffic lights.
Because “unobstructed’’ is a legally undefined term, there is the potential for police to abuse their discretion. In Kay’s case, he could clearly see the road in front of him. He also was told there had been a lot of drug trafficking in the area.
It’s not hard to see how this could become a tactic for harassment. The American Civil Liberties Union argues any stop based solely on what’s hanging from the rearview mirror would be held improper if challenged. A seat-belt violation isn’t a primary reason to stop a driver. A rearview tag shouldn’t be, either.
It just so happens that the same day I read this, I was listening to the Howard Stern show on Sirius and a guy called in and mentioned that he got a ticket (not sure in which state) for having a window mounted satellite receiver, which is exactly what I have. Now, I don’t know where this guy’s receiver is mounted, but mine is in the bottom of the front window on the drivers side, and it doesn’t obstruct anything but the hood of my car. – originally posted at Peoplehavethepower.org
